Where in the World is Balloon Boy Photo Contest

Who Can Enter

1. Entrants must be legal Colorado residents who are 13 years of age or older and have lawful access to the Internet and a valid e-mail address. Entrants must have permission from the subjects in the photo or their legal guardians to publicly post the image they are submitting.

2. Employees of Local TV LLC, KDVR, KWGN and Sky Venture (collectively, “Sponsor”), their affiliated companies, advertising and promotion agencies, and the immediate family members of each are ineligible.

How To Enter

3. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Only one entry per household. The contest begins when posted on October 19, 2009 and all entries must be received by October 25, 2009 at midnight.

4. To enter, go to the Contest Page at www.kdvr.com or www.2thedeuce.com, click on the Where in the World is Balloon Boy Photo Contest and provide all information requested. Entry constitutes an assignment to Sponsor of all intellectual property rights in the entry materials, if any. Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, likenesses, and photographs for broadcast, online posting, or in any other media, and/or any advertising and publicity without additional compensation.

5. Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner(s) or other contest information by Sponsor or entrants for any reason whatsoever. Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the contest or for entries that are late, misdirected or incomplete. All entries become the property of Sponsor and will not be returned. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE GIVEAWAY IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel the giveaway if it becomes technically corrupted.

6. Three winners will be selected by public voting based on the highest number of votes received from among all valid entries at the end of the contest. Users are allowed to place 20 votes per day through the end of the contest. KDVR and KWGN management has the discretion to pick winners in the event of a tie or obvious vote tampering.

The Prize

7. One grand prize winner will receive a Family Four Pack of flight passes to Sky Venture Colorado. Approximate retail value (“ARV”) is $192. Second prize winner will receive two introductory flight passes to Sky Venture Colorado, approximate retail value of $96. Third prize winner will receive one introductory flight pass at Sky Venture Colorado, approximate retail value of $48. Each Flight Pass includes Training Ground School, Flight Gear, Personalized Flight Experience with your Instructor, a Souvenir Flight Certificate and two minutes of flight time. The Flight Pass is valid for one year and is not valid on holidays or with any other offers. If you are a minor under 18 years old you must have a parent or guardian sign a waiver before you can skydive. Total ARV of all prizes is $336.

8. The winners will be notified by phone and/or e-mail within 24 business hours of the contest end date. The winners must bring valid photo ID to KDVR/KWGN, 100 E. Speer Blvd., Denver, CO in order to complete, sign and return a Certification of Eligibility and Release, which must be received no later than seven days following winner notification. If a winner cannot be reached, or does not return the Certification of Eligibility and Release within the designated time period, the prize will be awarded to an alternate winner, to be chosen by random drawing from among the remaining entries.

9. Prizes cannot be redeemed for cash or substituted for any other items by the winners. The winners cannot assign or transfer prize. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.

10. The winners are responsible for all local, county, state, and federal taxes on prizes based on the value of the prizes set forth in these rules.

11.Individuals are eligible to win only one prize within any 180-day period, regardless of the number of giveaways entered. Winners must claim the prize within seven days of notification.

12. Odds of winning depend on the number of correct entries received.

This contest is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the giveaway, or in the announcement of the prize.

13. By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsor, its parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsor’s use of entrants’ personal information as described in Sponsor’s Privacy Policy located at www.kdvr.com and www.2thedeuce.com.
